Use fourth. to find golfers and fill open tee times. You must be 17 or older. Be respectful. Don't post fake tee times or abuse the rating system. If you invite someone by text, you confirm they said it was OK. We're not liable if a round falls apart or someone is a no-show. Disputes go to arbitration in Colorado (except small claims). If something isn't working, email us and we'll try to fix it.
By creating an account or using the fourth. app ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms form a binding agreement between you and fourth. App LLC, a Colorado limited liability company ("fourth.", "we", "us", or "our"). We may update these Terms from time to time. When we make material changes, we will notify you via email or in-app notice at least 14 days in advance. Continued use of the App after that date constitutes acceptance of the updated Terms.
You must be at least 17 years old to create an account. By using the App, you represent that you meet this requirement. fourth. is not designed for, and should not be used by, anyone under 17.
You agree to provide accurate information when creating your account and to keep it up to date. You are responsible for all activity that occurs under your account.
fourth. is a platform that allows golfers to post open spots in their tee times and connect with other golfers who want to join. We provide the tools for connection — we are not a party to any agreement between golfers, and we do not organize, supervise, or guarantee any round of golf.
Important: fourth. does not guarantee that tee times posted in the app are confirmed with the golf course, that players will show up, or that a round will take place. All coordination between golfers is between those golfers. We are a platform, not a guarantor.
You are responsible for keeping your account credentials secure. Do not share your password. Notify us immediately at hello@myfourth.app if you believe your account has been compromised.
Your handicap index is self-reported. You agree to provide an honest and reasonably accurate handicap. Intentionally misrepresenting your handicap in order to gain an unfair advantage in money games or rated rounds is a violation of these Terms and may result in account suspension.
When you post a tee time, you represent that you have a legitimate intention to play that round. Posting fake tee times, tee times you have no intention of keeping, or tee times designed to attract and then abandon other golfers is a violation of these Terms.
fourth. allows you to invite people who are not yet users of the App by sending them an SMS text message containing a deep link. These messages are delivered through our SMS service provider, Twilio.
When you use the SMS invite feature, you represent and warrant that:
You are solely responsible for ensuring that your SMS invites comply with the Telephone Consumer Protection Act (TCPA) and any other applicable laws. You agree to indemnify fourth. App LLC for any claims, penalties, or liability arising from SMS invites you send through the App without the recipient's consent.
fourth. reserves the right to rate-limit, suspend, or disable SMS invite functionality for any user whose invite behavior appears abusive, unsolicited, or otherwise noncompliant with these Terms.

We reserve the right to suspend or permanently ban accounts that violate these rules, at our sole discretion and without prior notice in cases of serious violations.
fourth. allows golfers to rate each other after a round. By submitting a rating or any other content through the App, you grant fourth. a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App and in connection with operating the fourth. service.
You are solely responsible for the ratings and content you submit. Ratings must be based on your genuine experience. Submitting false, vindictive, or coordinated ratings designed to harm another user's reputation is a violation of these Terms.
fourth. is not responsible for user-generated ratings or content. We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful to the fourth. community.
When you use the round tracker and generate a shareable link, you are choosing to make certain information — your current hole, pace of play, and estimated finish time — visible to anyone who has that link. You are responsible for who you share that link with. fourth. is not responsible for any consequences arising from sharing your live round link with others.
fourth. does not currently have a formal no-show or cancellation policy for individual golfers. If a host cancels a tee time, players who have joined will be notified through the app. If a player fails to show up for a round you hosted, you may reflect this in your player rating for that individual.
We are not responsible for losses — financial or otherwise — arising from a cancelled tee time, a no-show player, or a round that does not take place as planned.
In future versions of fourth., golf courses may appear as partners in the app. Tee times featured through course partnerships represent offers made by those courses, not by fourth. Any booking made through fourth. is subject to the policies of the golf course. fourth. is not responsible for course closures, overbooking, or disputes between users and golf courses.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FOURTH. APP LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy of any user-submitted information, including handicap indexes or player ratings.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOURTH. APP LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:
Our total liability to you for any claim arising out of these Terms or your use of the App shall not exceed fifty US dollars ($50.00).
You agree to indemnify, defend, and hold harmless fourth. App LLC and its officers, members, and contractors from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, your violation of any rights of another person, or any SMS invite you send in violation of applicable law.
You may delete your account at any time by contacting us at hello@myfourth.app. We may terminate or suspend your account at any time if we believe you have violated these Terms, with or without notice.
Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including sections 11, 12, 13, and 15) will survive.
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App that cannot be resolved informally shall be resolved through binding arbitration administered in El Paso County, Colorado, in accordance with the rules of the American Arbitration Association. You waive your right to participate in a class action lawsuit or class-wide arbitration against fourth. App LLC.
Small claims exception: Notwithstanding the foregoing, either party may bring an individual claim in small claims court in El Paso County, Colorado, for any dispute that qualifies for small claims jurisdiction.
Before initiating any formal dispute process, you agree to contact us at hello@myfourth.app and give us 30 days to attempt to resolve the issue informally.
You acknowledge that these Terms are between you and fourth. App LLC only, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the App or its content.
If you download the App through the Apple App Store, you acknowledge that Apple has no obligation to provide support or maintenance for the App, no warranty obligation, and no responsibility for addressing any claims you have relating to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you as a user of the App.
If you download the App through the Google Play Store, Google is not a party to these Terms and has no obligations with respect to the App.
You must comply with all applicable third-party terms when using the App.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and fourth. App LLC with respect to the App. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
